The cost of licensing them is probably part of the reason. Most of the songs in Fallout 3 were relatively obscure songs by current standards, which was also true of the theme songs chosen for Fallout 1 and 2. Besides, Fallout is an alternate history and just like you won't see the Stardust and MGM Grand in New Vegas, Elvis and Sinatra probably had different histories as well.

Alot of it has to do with timeline,licensing fees, and feel. I dont think a song from the 60s like Viva Las Vegas fits in with a Rat Pack themed Vegas.

Simple reason, money. Most - if not all - of the songs in F3 were on the public domain.

Speaking of Public Domain, does that get thrown out the window if you use the song in a profitable manor?
I imagine it does, but it's probably soooo much cheaper to purchase the rights to a public domain song.

edit: the more I read my comment, the more I realize this is probably a really stupid question.

I love that song ever since i heard it in GTA SA. It definitely would fit in the game.

Exactly, thats a good thing about alot of Fallouts 1940's very early 1950's retro-futurism. Alot of the copyrights have either expired into public domain or are very cheap compared to some songs. It allows money to be syphoned to more valuable things game speaking, graphics, updating certian features, etc etc.

well it's actually not a big issue for me, if you are on xbox360 you can play custom soundtracks (on pc as well if i am not mistaken) > problem solved!
