Bethesda keeps on fighting

Just read this on gamespot.

All I got to say is.. COMON, I mean like.. I get it that they can't do a singleplayer game with fallout inheritance, but complaining on a website made to promote the future mmo which they have the rights to make... what? should their website contain no graphical content that can relate to fallout what-so-ever?

Am I just over-reacting or does anyone else agree? :P

hewhaaaat?! When I first read I thought only their website shouldn't contain any fallout material but when I read that (the quote) it looks more like... their entire game shouldn't have ANY fallout material, that is of course, if bethesda gets their way... wth!

if this is the case, then I am certainly NOT over-reacting! How the heck are they supposed to make a fallout game if they cannot use fallout material??? (assuming I got this right) Image

I disagee about Bethesda not making good single player games, some of the best games I have ever played were made by them and I have been gaming for 24 years. However I do agree with you on what they are doing to FO. I just can't see how they expect them to make a Fallout mmorpg without Fallout imagery lol. I'm sure a judge will see it the right way though.

I have a wierd feeling Bethesda is just trying to get them locked into a legal battle long enough for them to just say heck with it and call it quits on the whole project. Bethesda knows the potential money they are missing out on with a Fallout mmo. It's sad really the way our legal system works.

I can't see gamesas dropping it, they've been trying to make a Fallout MMO since LONG before Bethesda even had the rights to the series, it's fairly unlikely this is going to end unless Bethesda destroys it.

About gamesas not being able to use "fallout" material... Let's all keep in mind only certain things are that, the idea of a post apocolyptic world is not and nethier is anything they use in it (excluding something obvious like brotherhood of steel, enclave, ghouls, ect.). But they could just name them diffrent things and make them look a bit diffrent. who needs a ghoul when you have rad zombies. Also I find it hard to belive that Bethesda will take money from letting gamesas use "fallout" to make their mmo if they cannot use anyhting "fallout".

Unfortunately that is what Bethesda has been trying to take away from gamesas for a very long time now. It is within their rights to revoke all use of past Fallout content from the game as the game was only ever negotiated under a Fallout title. Bethesda made a good single-player Fallout series in my opinion, but they have to let the multiplayer go.. Well I guess we're just a couple of problem solvers

You have to remember guys that Bethesda is still going to get 13% Royalties for the game, JUST for use of the IP! Beth can't argue with that and gamesas DID start development within 2 years. Beth also gave gamesas rights to make a Fallout MMO in the original sale contract, meaning they can use whatever they like from the IP because it is 'Fallout'. To say that you can't use fallout trademarks is stupid, its implied under the contract that they can use it, as Beth gave gamesas the rights to do so!

Australian Law is a bit different the US, but Contracts are very similar. It just seems to me that Fallout Online will be a big hitter and fill gamesas's Coffers with millions of bottlecaps, and Beth doesn't like that one tiny bit.

Now let's remember guys by going ahead with the MMO, gamesas still hasn't procured rights to any Expansions for the Fallout MMO... Meaning there will be more legal battles to fight unless they release new content for free, or up the subscription rate to get around it. (legal loop holes, woo!)

From my point of View, I see Bethesda thinking more about thier wallets and less about the gaming community! I am a gamer. I want to play games I love. I want to see sequels and spin offs! Beth is ruining my chances of seeing a game I love with a genre I Adore! Fallout + MMo?! = Epicness!

Now I understand Beth Might be a tad butthurt by the events taken place but seriously? Your only hurting the gamers, US! And for that they receive no support from me. Think of others Beth, Think of those who are lining your pockets with bottlecaps and nuka cola to drink each day.

Now on a side note, I would like to say that Bethesda contracting Obsidian to make Vegas was a BAD move.
Obsidian has had me offside since they Butchered KOTOR2. Half the game was not complete and it had major bugs with what was left. Obsidian is yet to release a game that could be called 'Retail' and not 'Beta'.

But obsidian did improve vegas at some points :P (much better super mutants, compared to f3 supermutans).

But they were also quite limited by their outdated engine, they should had replaced it after f3 at least :/, so you can't blame all bugs on them. I am looking forward to Skyrim, to see what bethesdas new engine will look like Image

Bethesda has more power than some would think in this argument. Also, Obsidian did alright on New Vegas. At least they made a lot of reference to older gamesas games. I could stand most bugs with it. Did anyone else get the Hispanic voice game crasher after talking to EDE? Well I guess we're just a couple of problem solvers

For me the question got a quick answer... I didin't played the Bethes Fallout. THe First person, hugly 3D crap fighting, shitty scenar was enough. It was more like a 90' third zone game.

gamesas made a big mistake by selling Fallout. Money, money never change...

But i've read that a judgement had given all the rights to gamesas, Bethes didn't want it for 50M then F*** Off. Enough of this kind of "developper" who don't know about real gamers. If fallout was just a shoot them up, then Bethesda should be the winner.

But Fallout is more like a AD&D when you rool the dice and got a real hit!, when you expect something special behind the next door, when you're surprised by the scenario and you laugh behind your screen.

If we can do this has a team it would be nice, and the only one who can do that is gamesas with their team...

Bethes could just expect DDoS from me.

Question with the legal side of things:

Is this case a public or private court case? And if its Public, can any citizen walk in to the court and get a copy of the proceedings?

Interesting, no?

EDIT: Im Australian so I'm not sure if your (USA) Legislation allows for this to be done.

Oh and btw, While California is suffering from nuclear winter, Australians are down here drinking Fosters on the beach.
