Can you legally defend yourself?

Lately i'm reading articles in the news about kids like 10 to 12 years old committing acts like robbing people, attacking people either kids or advlts, etc... . As the title asks if 3 kids about 10 to 12 years old start attacking an advlt can the advlt legally defend themselves without getting sued?

It depends on where you are.

In the UK, I think you can use an appropriate amount of force. Meaning if you believe you are in danger you can use quite a lot. If you are simply being robbed, then you can't go and shoot someone.

If, let's say 3 hooligans of adolescent age start attacking an advlt, the advlt could reasonably fight back in order to protect themselves and they wouldn't go to jail, but being sued is a different manner. Now, the parents of the kids could easily file to sue the advlt defending himself, but the advlt who was attacked stands a good chance of winning the case. Also, the advlt in the question would have the right to sue for compensation for any medical bills incurred in order for him to recover from damages received during the attack. Could also sue if any personal affects were broken.

Note: the above assumes that judicial system has ample evidence to determine what really happened in the attack and that the advlt did not conduct any legally innappropriate or unreasonable actions, like escalating the violence through the application of lethal force.

edit 1: to give a better example, you can be found innocent of murder and successfully sued for wrongful death.

In some areas I've lived you are allowed to decpitate anyone who tries to steal from you with a variety of sorts, and if a burgler is caught you can imprison and execute them.

EDIT: I know not what the laws are in your state/area of residence, but if anyone were to steal or attack me anywhere I would kill them.

I would say it's possible, but I'm no lawyer. People should know by now that kids at that age and above aren't little angels. Just look at bullying.

He meant 'can ONE defend themselves', not 'tell me about your kicking ass ability' :rolleyes:

America currently but I came from Bahrain and grew up in surrounding areas which had the system I said earlier, the justice system here alot of times is flawed and isn't as effective as it could be.

I have experience with this actually.

When I was 14, me and some friends were roaming the neighborhood a little past midnight (weren't doing anything illegal, just walking around). Apparently we were being pretty loud, cause some paranoid guy ran out of his house with a taser and a flashlight and started chasing us down the street. I was the slowest of the group, so the guy caught up to me, threw me down on the concrete and started yelling at me that we broke into his car (we didn't, we were in front of his house on the sidewalk, his car was in the back). Eventually I convinced him not to drag me back to his house, and gave him my cell phone to call the cops. When the cops got there, the guy told them I was on his property, I was too freaked out to say much of anything, and, despite finding no evidence that we were anywhere near the guy's car or even that we were on his front lawn (again, we were on the sidewalk), the cops told him he was completely within his right to defend his property and attack me.

So yeah, apparently, in Texas at least, you're allowed to chase down a bunch of kids, tackle one of them and threaten to tase him without having any proof that the kid was on your property and you'll have done nothing wrong. <_<

I think if you're not legally an advlt you can go ahead and do what you want (besides kill them of course) but if you're an advlt your best bet would probably to overpower and disarm the assailants. 10 - 12 year olds aren't too hard to handle, I can manage fairly well in a hand-to-hand or even against an opponent armed with a switchblade, bat, or similar weapons. :toughninja:

But I'll admit that it's a really sensitive situation, and honestly hope I never get into it as there are so many possible outcomes, many of which that aren't pleasant for either party.

yeah, that reminds of the time where a guy killed 2 people that were on his property and they were trying to break into his neighbors house or something like that.

it is a sensitive issue and the whole use of the castle doctrine can be a little loose in some states.

Due to the disparity of laws governing defense of self and others not only in the USA but around the world, not only is this topic impossible to answer correctly but it leaves open to folks admitting to illegal actions against others. Beating them up or killing them in areas where it's not allowed. Since we moderators can't possibly know the laws in each of the places where you all live, it's best just to disallow this topic of conversation and keep you all from being warned for admitting to actions which may or many not be legal in your area.
