Class Action against Bethesda?

I've got the problem of the game crashing on the loading screen, after you select the Vault, it crashes right at the end just before its about to display the vault & enter the game.



I've done what debugging I can do of the app when it starts, I've come to the conclusion its simply running out of memory (Ram) on the phone.



I've got a 4S, whilst not optimised for, its supported as I can download the app and run it. I can also buy lunch boxes and herein lies the problem.



My thoughts are that Bethesda must have come up against this issue when they tested the app (yes, I'm sure they did some testing) they must have known that the older devices would never stand a chance of getting to the 200 dweller limit (I was at 50, btw). So why, if they knew that the game would crash at some point, do they allow the app to be run on those devices, take people's money, knowing that they'll run into an unsolvable problem.



Hell, this bug even affects people on new hardware that have got up towards the 200 limit.



So, I would suggest to Bethesda, either you reduce the memory footprint so that the game loads on older devices or simply block them from playing the game.



Otherwise you're ripping people off as you're selling stuff in the knowledge the game will sooner or later get to the state where it will not work.



And refunding those who request it would be a good place to start too.



At this rate, its putting me off buying Fallout 4, I thought Bethesda were better than this.



What do we have to do to get a response from Bethesda, start a class action law suit? Surely not.



(btw, I am an existing member, but the account reset code that they sent me triggers their Cloudflare anti-hack system and I can't get back into my old account!)

Bethesda will just point you to apple Tos which more or less says that you are the one responsible for any software that you DL and install even from there store.


Apple will just tell you to buy a new phone.


The courts here just read the Tos out loud to you then look at you funny then charge you with courtcosts that are more than the price of a new iPhone. Yes they will do that because they will consider the lawsuit frivolous



And you will be out the time you wasted and the price of a new iPhone and whatever the lawyer charged you to take the case, and still not have a new iPhone

I'm enjoying our chat in the other thread Steve, but this is like complaining that the Xbox 360 won't run the next Fallout.



As the game is designed now, it isn't supposed to run on the Iphone 4s. That it does initially is because the vault takes less RAM when you have fewer dwellers. Do I think they should make a version that does support older Apple products? Hell yes. But on the app store page, it does prominently display what the supported devices are. In the description, its literally the very first thing mentioned. That and Todd kinda said what it would run on back when it released. So Bethesda has communicated clearly what it should run on, so they at least are completely iron clad from any lawsuit.



You might be able to TRY to sue apple for letting you download a game in which you can spend money on a device that the Devs themselves said isnt supported. But I think their ToS would make them immune too, even if its kinda a dike move.



You'd have a hell of a time getting a lawyer of any repute to take your case if you wanted to try to sue Beth, and even if you did get one you'd be laughed out of court within minutes. Sorry dude, I know it svcks to be unable to play a good game but you'll just have to wait for a patch to let an iphone 4 play it, or until you get a device capable of running it.



EDIT: Did you know pressing the home button twice quickly pull up a list of all active apps? wipe an app up to close it and free up RAM. Also, turning your phones wifi off, and putting it into airplane mode uses a LOT less ram. You should try those things out.

Definitely still buggy. Reason #1 im not spending any money on it just yet. Once it feels like its out of the beta stage, I throw some cash at them though.

It was originally stated that the game would run on older platforms like have 4s. Some one as posted screenshots of this multiple times. It was later changed to read iPhone 5 and up.

Call Apple and they will refund your in app purchases.

Its not really the same though is it, however, if they made Fallout 4 available on the 360, knowing that it'll crash half way through because it can't cope with the game, then it would be exactly the same. Its not the case that I can't play it that annoys me (well it does, but that's not the point), the point is that they've released it and allowed it to run on older devices, allowed you to spend money in the game, knowing full well that it will fail sooner or later on the older devices. Its like paying for a pay-per-view when the broadcaster knows they can only show the first 20 mins of the event, but they let on that they're showing the whole thing.

I've just read the sticky post on here that states that "Devices with 512 MB of RAM are not supported. This includes the iPhone 4s, iPod Touch Gen 5, iPad 2, iPad Mini Gen 1."



I'm sorry, but that's making things worse. This is NOT stated in the App Store, the game will actually run on devices with 512MB of Ram, its not coded so it won't.



So they acknowledge that it doesn't work on older devices, but allow it to run and take your money, in full knowledge that it will crash eventually, that's immoral Bethesda.



I'm NOT impressed Bethesda...

Well, it was titled more rhetorically than anything. I'm not US based, so couldn't start one if I wanted to.



They are US based though and we all know the US legal system allows you to sue for stupid reasons (such as the one you mention) or that Hot Coffee, surprisingly, is hot.




That said, they are taking people's money knowing full well that people will trip over this bug sooner or later.

Well, because at the time it was working perfectly.... It was only when I got up to towards 50 dwellers that I started hitting problems.

I'm playing on an (unsupported) IPad 2, so I'm tempted to call it a day at 100 dwellers.


But at around 80 dwellers, I've not had a crash yet.



And the courts system are not designed to legislate on 'stupid'...

People like to quote the "hot coffee is hot" case as an example of a frivolous lawsuit, except that in that case the coffee was far hotter than it should have been and caused more severe injury than would have occurred if the coffee had been at the standard temperature. That case had nothing to do with stupidity.

That's lucky . I was playing on an iPad 2 for a couple of days to start with and it was really crashey even with a dozen or so dwellers. Crashed every 15 minutes. Bought a better iPad just to play FS.

That's not how things work in the App store. Unfortunately you cannot mark your apps as not running on certain hardware, only on certain versions of iOS. So if the 4S can run the latest OS, it cannot be excluded from your app.



This is something that Apple actually needs to implement on their end. Bethesda doesn't have much of a choice here.

Still, if it was brought before a court in the UK, it would have been thrown out as frivolous. Hot coffee is hot, be it 70°C or 100℃.

No. I'm looking at it again, same as yesterday, it literally reads word for word what I said. It definitely says AT LEAST. It is OPTIMIZED for the Iphone 6 and the Ipad mini 2, though on this one I'm running off of my memory so I could be wrong.



And locking the game so it cant run on older Apple products is not smart. People still like the game and want to play. Most have learned their vaults essentially have a dweller cap. It's kinda like a demo, a preview of the game. If people like it they can pick it up and play it properly when they get a newer device that supports it, and then if they buy Lunchboxes, Bethesda makes more money. The burden of stopping you from spending money is not Bethesda's, they've done their due diligence. No, the burden is on you, and Apple for letting you DL it when Bethesda clearly has communicated some devices cant run it. You should ALWAYS do you research before spending money on ANY in-app purchases. Always, for any platform.



Bethesda made it plain on the page what it runs on, and Apple is too lazy to help support that by letting older phones download it. The least at fault here is Bethesda in this situation.

I highly doubt that. The woman suffered third degree burns to 6% of her body and only took the company to court after they refused to settle. The coffee in question was 10 degrees Celcius hotter than industry standard and hot enough to cause third-degree burns in 2-5 seconds.


There was nothing frivolous about the coffee case.

Beta-thesda is a company run by hacks and frauds., Sure you can get a refund but that is only for those who complain about it. If that doesn't classify as a scam, I don''t know what does.


I mentioned it before, I am so freakin' p'ed off at this company. They simply cannot make decent games. They lower the bar by miles when it comes to quality gaming. Look at their "games". It's bad programming, bad modelling and simply p*ss poor graphics. All the art work from Fallout (from gecko's to ghouls, from the BOS to Enclave and from super mutants straight down to the pip boy), was done by Black Isle, so they don't deserve any credit for that, either.


Hacks and frauds.


Ps, I amon iPhone 5s. My game doesn't even get past the first loading screen anymore. I have invested about 35€ in this bogus app. Complaining against these issues got me my account suspended by 2nd hand company employees (forum moderators) because it was their opinion that I was ranting and spamming. Guess what moderators, that's what pissed off customers do. SO F*CKING DO SOMETHING ABOUT IT!


Censoring customers only gets them more angry.


So far, Bethesda's OFFICIAL support has been zilch, nada, nothing. They don't have the decency to even acknowledge these issues.
