the difference between DX9 and DX10 is almost none, on crysis 1 you could force very high settings on DX9 and get almost the same graphics, and cryengine 3 already have some DX10 components already in it, so you can imitate DX10 features on a DX9 game
the main problem is DX11, which adds tessellation and deffered shadows, probably crytek did not finish the DX11 patch in time for the release, or they have a contract with Nvidia who sponsored them

but DX11 is not important Graphic wise, it doe not increase texture resolution, it does not increase destructibility , it just increases Polygon count on stuff, and with all the amount of stuff (cars, cans, boxes, derby, trees) the tesselation would drop performance drastically, so my guess is that crytek is working on a DX11 patch that does not affect so much at the performance
I do have a DX11 card ( the HD5770 and im planning to get the 560ti crysis 2 edition) and when enabling Dx11 on games like Stalker or metro 2033, i get a big performance drop with little improved visuals (for example the tubes on the gas masks have 24 sides instead of 12)
However instead of DX11, i would like crysis to add more destructibility to crysis 2
