Crysis 3 fullscreen vsync fps issue

Okay so when I open the game even with vsync on it says 120fps and when I am windowed vsync doesn't work but the sys_MaxFps is working at 60fps.

My question is how do I enable vsync and actually have it work? I get terrible tearing and for some reason my 40" samsung 1080p lcd says 1920x1080 @ 60hz even when I'm at 1280x720 @ 60hz.

I set my desktop to 1280x720 and the game to 1280x720, yet my lcd says it's at 1920x1080 @ 60hz. Maybe I need to dial in some settings in the Nvidia Control Panel...?

I'm running the latest driver as of now being 314.22-notebook-win8-win7-64bit-international-whql. Even ImToo Video Converter says I need to upgrade my driver to use Cuda Support. I was using Cuda on older drivers. So do you think it's my driver?

Basically all I want is my LCD to display the correct resolution, like I want the lcd to say 1280x720 when the resolution is at 1280x720.

*UPDATE*

Went into Intel Control Panel and set "Maintain Display Scaling" so far on the desktop fixed the resolution issue and I'm guessing it'll fix the in game issue as well. Will update as soon as I try 314.07s supposedly built to run Crysis 3.

*UPDATE 2*

Fixed the resolution issue showing 1280x720 in game on the lcd. Anyway Vsync and sys_maxfps do not work. I open up the game and it's at 120fps with vsync enabled. I go to windowed and the fps is at 60fps, so it's a fullscreen issue where it defaults to 120fps... I don't like that... I want vsync to work without using sys_maxfps.

In regards to 314.07 can't really tell seems to run good I'm all maxed out everything very high with a bunch of tweaks in the config using CryConf i think it's called. If anyone knows how to fix the fps vsync issue please let me know! :)
