I know I have to upgrade, but according to system requirements it should run fine with this card, but it stays steady around 44fps then drops back to 16 fps for a minute, back to 44fps and back again to 16 fps, and on and on and on.

Hmm, that is pretty radical. I just used FRAPS to record the MinMaxAvg for 3 mins on, the Min was 28, the max was 57, and average was 42. So I'm not seeing the massive jumps from 44 to 16, other than when I first load the game, and normally on the first explosion, after that it's pretty stable in the mid 30s.
Granted, down at the mid 30s isn't where I'd want to be, but it's good enough to play through if one didn't want to spend the cash on new card for a mediocre game. Obviously, there are plenty of folks that consider 35-45 fps average to be unplayable and I'll say that's a valid opinion.
Have you looked into The advance Graphics Option utility? Might let you tweak the game more to make it playable

I think it is a memory leak or something like that. Because it is not influenced by big explosions. It just happens randomly even if I don't move at all.
Game is far from ready. This is one way to destroy your brand and reputation. EA & Crytek have a couple of good brand managers, right.....
I bought this game because of Far Cry and Crysis 1 with the understanding it would be a good game. I won't make this mistake again. I like DICE better, BF is much better.
