Elder Scrolls FanGame violates the rights of Bethesda? : Othor Games

Wanted to ask about what is the position of Bethesda, in relation to fangames? It is a freeware. It is a simple 2D platform game based on old SNES games. Knowing that it uses trademarks of Bethesda. The protagonist is a Khajiit running after sweet rolls.

It violates the rights of Bethesda?

Yes. It's stealing the property they took years to create and establish.
