If Bethesda worked out the legal issues, do you think they should remake Fallout 1, and 2 in the way Fallout New Vegas is?

Absolutely not. There were some things in the originals that Bethesda will not do. There would be no map-node system and as such the Highwayman would be dropped as it wouldn't be needed. Also many locations would probably be cut or changed to fit into the "smaller" world map the new games have. I'd rather not have Broken Hills, Vault City, Redding, Modoc, New Reno and the Den all crammed together within spitting distance of each other.

A lot of content in general would be cut or changed. One could go on and on going over how remaking the originals would be a terrible idea. The charm of the originals would be completely destroyed, that's plenty reason enough not to remake Fallout 1 and 2.

Only if it's 10 years down the road when all of those who played the originals are all old and don't care. By that time engines should be advanced enough to a have the first person view and detail of Fo3 and NV while having a map as large (or larger than) the originals. So as of now, no.
