Fallout 4 EULA

I suggest anyone interested in creating mods read the Fallout 4 EULA posted on Steam.

A small section is:

"All Customized Game Materials created by you are exclusively owned by LICENSOR and/or its licensors (as the case may be) and you hereby transfer, assign and convey to LICENSOR all right, title and interest in and to the Customized Game Materials and LICENSOR and its permitted licensors may use any Customized Game Materials made publicly available to you for any purpose whatsoever, including but not limited to for purposes of advertising and promoting the Software;"

In other words, you convey ownership of any mods you create to Bethesda.

Another interesting line:

"Customized Game Materials must be distributed solely for free;"

In other words, no charging for your mods.

One more:

"Customized Game Materials cannot contain libelous, defamatory or other illegal material, material that is scandalous or invades the rights of privacy or publicity of any third party, or contain any trademarks, copyright-protected work or other property of third parties (without a valid license);"

Looks like nudity mods are now illegal - or at least you can get sued for them.

None of these things are exactly new, they are all present in the Morrowind EULA too, and all the Bethesda Game Studios games since then.

yeah that is the normal EULA from F3 and Skyrim too.

They do this so people can't charge others for mod's they have made.

None of that means nudity mods are illegal.

And has been said by others, none of this is new. Standard boiler plate. And if you ever thought you had ownership over something you created with someone else's assets and tools ... well, you never did. Bethesda has always owned the rights to any mods made for their games.

Well thanks for the clarification. I guess I never read the earlier EULAs...

This sounded an awful lot to me like new changes to keep Sony happy with the thought of mods on consoles.

Still grates that if I create a brand new Quest - Bethesda owns it. I should charge them rent.

If this is all old news - lock er up..

Yeah, it's standard for developers to own the rights to any mods created with their tools and assets.

If it makes you feel any better, I don't technically "own" any of the projects I did while in college for my BFA. Technically, even anything I did on the side apart from my classwork is owned by the Savannah College of Art and Design, whether it was homework or not. Developers aren't the only ones who claim rights to content made with their tools and assets - it's a long-standing tradition in other fields.
