That's what I have been saying since this all started. It's free hype for Bethesda and as long as the people behind this aren't making money there is no real reason for Bethesda to take legal action.
If this is fake, the people behind it could be betting that Fallout 4 will be announced soon. Bethesda might be getting ready to announce it and this is all just a nice coincidence.

Considering the sheer power that Bethesda's legal team posses and how common it is for other people to try and use a game developers clout to garner attention to
themselves and benefit from it yes. Not to mention the fact that they paid a good chunk of change for the IP, or the fact that copyright infringement is dealt with swiftly
regardless of the context it's used it, anyone who tries to upload music to YT can tell you that.

The two main reasons I treat this site as legit is that while what Rohugh and Styles are suggesting is certainly plausible, Bethesda's history of handling such matters suggests this would've been shot down if it were fake. Meanwhile, the style of the site, AKA a rather pathetic tease that provides next to no information whatsoever while expecting people to wait a good month for any actual info? That has Bethesda written all over it. I mean forgive me if I'm mistaken, but wasn't Dawnguard's initial tease a friggin' PICTURE with the DLC name on it? And people spent a good month anolyzing every inch of it?
Sure, if they could afford to fund this website with a server that can handle all this traffic stress. And also somehow license it to Bethesda and Zenimax without taking heat from their lawyers for copyright infringement.

There's a whole lot of points in favor of the site being real, and also one could claim that the [censored] up and the lame [censored] the countdown was leading to is proof that it is Bethesda. I mean, think about it: Dragonborn was promoted as being Skyrim: Lonesome Road with Miraak being the man, turns out he was just HM's [censored]; the games always being full of bugs.
