Since the soft level cap is at 50, I think guards should be relatively close to/around 30, so for the initial portion of the game they are this opposing force that you should avoid messing with.
But once you've reached level 40+ and have gone through trials and tribulations, explored every corner of the lands, conquered undead, and slayed dragons, guards should no longer pose a threat to you. And by then, word of your accomplishments/destruction should have spread throughout the lands and you should have become this awe inspiring hero or fear inducing villain in the eyes of the people that no one would mess with in their right mind. It would be sweet if you could hear the townsfolk pvssyring about you and your quests as you walk past, similar to once you had become the champion of Cyrodiil in Oblivion or the champion of the Arena, etc... --- Except in Skyrim that sort of status should actually come with certain perks.
If you're a kind hearted hero, people should recognize that. For example, in certain taverns and inns, it would be awesome if the owner said, "Hey, you saved Sir Such and Such's child and slayed the Dragon that was attacking our town, you can stay at my inn for free!" And if you're a villain, you should, in some situations, be able to get away with certain things that you normally wouldn't be able to. Like if you walked into a smith's shop and saw a particular blade that caught you eye, if you could take it and just walk out without any repercussions that would be crazy, because in reality if he knew you were this god-like, insanely powerful evil-doer, he would most likely overlook you taking that sword because he would realize that his one sword is not worth his life.
It would be so awesome, and make the game seem soo much more realistic.
