The disk is damaged when one moves the console during use. However, it is undecided whether this from a defective product or misuse from the consumer.

Without having the full knowledge of the disc system and the terms and conditions that the consumer signs up to upon buying and using the 360, the warnings given in the documentation, as well as whether the scratches were caused due to moving the console when the disc is in play, how is anybody here going to be able to give you an accurate assessment of who is at fault? I mean, IF it says in the documentation not to move the console while the disc is playing as it may cause damage, and IF the consumer did just that and IF that caused the damage then obviously it is the consumer's fault, but there are lots of variables that we don't know. I find this an odd poll, as you're asking for an opinion when the answer is a fact, as we not partial to the information necessary to obtain those facts.

The fault is on Microsolft. They have to make sure the products they make and they sell for a fortune last long.

Its the consumer who bears the burden of proof as they are bringing the action


However since its a civil matter rather than criminal the standard of proof required is lower, on the balance of probability rather than beyond reasonable doubt

The 360 came with RRoD and other problems like the DVD drive going out and crap. That console was a consumer risk in the early years, but they designed better since then.

Never put the PS4 on its side while playing, I'm currently stuck in the Arkham Knight Universe and Hell is a much better place than this. My limited knowledge of the Batman universe is somewhat helpful but I could really go for my .44 Mag at my side right about now.

:D.

Anyway I'm kinda half N half on the lawsuit here. On one side the consumer could have bought a faulty unit and Microsoft is guilty of putting out new consoles which have known to have defects. On the other hand the consumer could have damage the product on his own in which case it's his fault. Reasons like this I keep my system flat, to avoid scratching the disk and avoid opening portals to alternate dimensions :D.

If you move it around while it's running then that's your fault. I never understood why people like to stand the console on it's side...you're just asking for trouble.

I bought a 360 just after they came out to play oblivion, I got oblivion the day it came out, and in the first two hours of playing, I knocked my 360 over and it ruined my disc.


It was all my fault, not the fault of Microsoft.


Yes, Microsoft sold crappy products that died in a year (I had two 360s that died in a year each, and I know some people who went through upwards of 5 of them), but in a free market they are allowed to do that.


My solution, I gave my Xbox stuff away and bought a ps3 that I've owned since fallout 3 came out and still works perfectly. I even moved it and knocked it over with a disc in it and never ruined the disc.


I personally don't like Xbox because I don't like the quality of their product, but I don't think they should be sued for it. It is what it is, it works as advertised, you can pull it out of the box and play games instantly. They never advertised that it was superior quality or that it wouldn't screw up your discs if you moved the system while the discs played.

In fact my Xbox had a little sticker that said don't move the system while a disc is in the tray. So they covered their ass on that.

I think I was told by a MS personal one time the reason for placing the unit on its side was for venting purposes, but I've always uses the packing styrofoam or cardboard box to lift the unit and give it an even better ventilation, heck I'm doing it to my PS4 as we speak---er type ^_^.

I was always taught not to move stuff like that when it's on, period.


All the way back to cartidge games, desktop PCs, cassette players and VCRs.


Tilting an Xbox on its side would never have occurred to me if was never shown to me as designed to stand that way without a separate stand.


We never tried that with DVD players. I always just stuck slats of wood under stuff for more air flow.

Funny, I have the opposite change. In my early lifetime, we probably went through 8 different PS2s... And my personal original Xbox, and first Xbox 360 are still alive and kicking after so many years of us. Yes, my Xbox 360's disc tray doesn't work when it's empty and my 360's disc reader lags in the cold but otherwise. My 360 works very well still and plays just fine.
