Just wish I could have a picture of the judge looking at this then slapping the burglar telling him "No!". I would so make that my desktop in a heartbeat.

Been like that for some time, once a robber fell, hut himself in a break in, sued and won. The law is stupid. But the problem will solve itslef, when the law makes people take it into their own hands, and eventually those who see how stupid it is will be in power.

Hmmm, I might just steal a bike, sue for damages, pay my bail and walk with a nice $250,000.

...on second thought, maybe I'll continue being a level headed, common sense following, law-abiding citizen.

If I was the judge I would throw my gavvel at him, sue for wasting my time, and having him in prison for theft. Also the lawyer would be in prison for being a greedy [censored], who sided with a thief and helped him benefit and not the victim, I hate lawyers.

Dupree filed the civil lawsuit on his own, without the help of an attorney.

All I see in there is that some idiot is suing somebody he tried to rob for subduing him. Nothing in there says he WON the case. Why all the moaning?

Already a Lawyer in Florida who is suing to have the Castle Law overturned preventing the common citizen from defending themselves by any means necessary including using a gun.

Fair enough, I just clicked the link, read the title and based it on the other cases I had read to save time.
Still hate them though.

@Expressate they usually win these things.

Let's just hope http://ui01.gamespot.com/1984/judge1_2.gif guy isn't the judge.

It's incredibly stupid. Hopefully it will be thrown out of court.

Well he hasn't won. In the likely chance he manages to lose this case, the defendant can countersue. He would have a MUCH stronger case.

Jesus, every time an idiot makes it into the news everybody freaks out. So they're getting on TV now, what's changed?

But they usually win these things, so that likelyness of a counter is low.

Probably because no attorney would take such a hopeless case. You can file a law suit for anything now days. Winning them is another matter.

I remember some story from England, I believe, where an intruder sued a homeowner because he slipped and fell on the wet kitchen floor.

I remember a case in the UK where two men of family managed to overcome the robber, chased them down and beat them badly. They were sentenced to jail for it. This sounds like a similar case.

I can understand this from the law's point of view, when they are out of your house it ceases being self defence and starts being vigilantism. From common sense point of view, you break the law, you lose it's protection :stare:

Dupree alleges McKoy and two other men pointed a gun at him, handcuffed him and placed a knee painfully in his back.

cops pretty much do it the same way

I wonder if he'd sue the cops if he had gotten arrested by them

Still reminded about that group of Obese people that filed a lawsuit against McDonald's. They said it was McDonald's fault that their food made them fat. :cryvaultboy:

I see it as justice, what they did to the guy, not what the law did to them. He wont be stealing again, and it works better than prison.

Hawai'i changed it's law last year in regards to criminals in your house. It used to be that the victim would have to leave the house (yes... it was THAT stupid) and the criminal could sue you for damages if he got injured. Now, you can pretty much go Texan on them if they break into your house and you feel that they are a threat.
