Nothing is said about illegally passing over the border, just that you are caught on the border, they don't say why so my point stills stands. You are being executed for whatever reason you wish.

Bethesda must have a thing for jails. I still would have liked to know why you were in jail in Oblivion. If they actually do the execution thing, I hope they will have a back story behind it.
