Can you sell Oblivion Mods? or would that be illegal?

It's illegal, technically, Bethesda owns all mods outright. No one can charge or gain money in exchange for mods.

Except for Nifskope, Blender and such tools.

Edit: of course I guess a person still needs the CS so the game makes use of any third party meshes.
