I think people are overblowing the technical limitations aspect of the previous policy of no console mods. Sure there are some limits but there are lots of things that could be done on consoles in terms of mods that would open up all sorts of possibilities for people gaming on those systems. Todd has said in the past when this came up for Skyrim that mods on consoles worked and that they've tried them in studio which shouldn't really be all that surprising when you consider that all DLC is in the end is official mods you pay for.
This has always been a largely legal / policy problem originating from the console makers, technically it could have been done some time ago. Now, the whole thing still could end up as a complete disaster of course so we'll just have to wait and see exactly how it is going to work before saying it's DOA.
