Skyrim is the home of the Dark Brotherhood so it will be in the game.

There's still an Empire, it's just not in great shape. Otherwise, there wouldn't be a civil war over secession.

Also, I don't think the Morag Tong would make much sense in Skyrim, being primarily an aspect of Dunmeri culture. Yes, I know the Dunmer are spread out through the other provinces since Morrowind took nine kinds of beating, but I can't imagine Skyrim's government allowing a legalised assassin guild simply because some surly elves told them they should.

I like the honor of the Morag Tong and the illegalness of the Dark Brotherhood. I don't like being able to just write off my murders. I like to do it secretly and possibly with the punishment that goes along with murder.

So I choose the Dark Brotherhood out of the two.

The Morag Tong doesn't have to be sanctioned by the ruling government of the land. Morag Tong would operate illegally if the Empire made the organization illegal.

The prime objective of the Morag Tong is to "prevent massive bloodshed with calculated killing", which the empire was able to put to use, but the empire didn't start the Morag Tong, it's a religious group.
