Official TES V Speculation Thread Number 28

There is NO OFFICIAL information about a new TES game release.

This thread is for member speculation of when and if TES V will be released. This is where you post any new information about when it might be released, tidbits from interviews which mention it and such.

It is also where you post your theories of when you think it might come out based on guesses, number crunching, rumors or such.

This is about speculating on the next TES game and when -- or if -- it is going to be released. It is not a place for discussion of what is going to be in it, what type of graphics there will be, or any other subject of that type; they belong in the http://www.gamesas.com/index.php?/topic/1090035-tes-v-ideas-and-suggestions-164/. If those kind of posts get raised they will be deleted and the poster warned for going off topic.

SJML looks at the speculation topics pretty frequently, if fact he's one of the only developers I've seen lurking here. I think after he got that lovely quote from Seti to put in his signature, he's looking for more. :laugh:

Ha, i was just about to post the same thing! I just flicked through the last thread and realized that half the thread you guys speculated about whether the speculation was moot speculation or not (big thumbs up for the lols :thumbsup: ) Anyway the last page had something interesting where a guy asked if a flash game could be enough for beth to keep the trademark, which got me thinking...how much information do beth need to show to the trade-markers to keep the trademark, and how much publicity do they need to give?

The exact threshold is probably subjective to the official overseeing the particular trademark, but here's how I would answer your question: First, it's not about "keeping" a trademark but rather about obtaining one. Their trademarks are technically still pending. In order for Bethesda to actually obtain the trademark, they need to prove its use in commerce within an allotment of time. That allotment of time is about to expire, which is why they have to either announce it soon or start all over again in the trademark process and risk losing their trademark and waiting up to a year to be able to use it. There's really not much variation (that I can think of) as to what constitutes use in commerce other than something with the name "Skyrim" being publicly offered for sale.

As for the flash game idea, I would expect that if they did that then the name "Skyrim" would be exclusively attached to that particular product and I don't know if they could transfer it to another later. This is one area where my knowledge of trademark law falls short. Another strike against this idea is that it's something that to my knowledge has never been done before in the gaming industry just to obtain a trademark.

I don't know if you are familiar with this or not, but are you familiar with the Dragon Age Flash Demo? It was supposed to be a sort of hype-builder/story teaser about the Dragon Age Origins game I think, it's on Kongregate if you don't know where it is. Anyway, if you are familiar, would that count as giving evidence of future use of the trademark?

They could just show the trademark offices that they're working on it.

Personally, if I were you, I would love to watch us desperately convince each other that you guys are working on TES V, and then freak out when we see a developer such as yourself watching. We're like cats with a laser pointer. :P
