Official TESV Speculation Thread #74

Post » Sat Feb 19, 2011 5:58 am

There is NO OFFICIAL information about a new TES game release.

This thread is for member speculation of when and if TES V will be released. This is where you post any new information about when it might be released, tidbits from interviews which mention it and such.

It is also where you post your theories of when you think it might come out based on guesses, number crunching, rumors or such.

This is about speculating on the next TES game and when -- or if -- it is going to be released. It is not a place for discussion of what is going to be in it, what type of graphics there will be, or any other subject of that type; they belong in the http://www.gamesas.com/index.php?/topic/1112872-tes-v-ideas-and-suggestions-177/. If those kind of posts get raised they will be deleted and the poster warned for going off topic.

Please note that this thread is not a personal chat box and that one liners and posts of little substance will be considered as spam and thus the poster will be subject to warnings and suspensions.

No scans of copy righted material are allowed in this thread. Any claims to having insider information will be removed. All other forum rules apply. You agreed to them, so please read them.

Note that Bethesda Game Studios is NOT working on Fallout: New Vegas, Rage, Brink, or Hunted: The Demon's Forge -- Nor do they develop MMOs.

So, I was going over the trade mark and noticed that they recently updated it this month, this trade mark clearly shows the updated it.
http://www.trademarkia.com/skyrim-85094021.html
"PUBLICATION/ISSUE REVIEW COMPLETE"

Which means,
"PUBLICATION FOR OPPOSITION

___From http://www.uspto.gov/trademarks/process/afterapp.jsp

If the examining attorney raises no objections to registration, or if the applicant overcomes all objections, the examining attorney will approve the mark for publication in the Official Gazette , a weekly publication of the USPTO.

The USPTO will send a NOTICE OF PUBLICATION to the applicant stating the date of publication. Any party who believes it may be damaged by registration of the mark has thirty (30) days from the publication date to file either an opposition to registration or a request to extend the time to oppose. An opposition is similar to a proceeding in a federal court, but is held before the Trademark Trial and Appeal Board, a USPTO administrative tribunal. If no opposition is filed or if the opposition is unsuccessful, the application enters the next stage of the registration process. A Certificate of Registration will issue for applications based on use, or a Notice of Allowance will issue for intent-to-use applications.'

Followed by

CERTIFICATE OF REGISTRATION OR NOTICE OF ALLOWANCE

If the mark is published based upon the actual use of the mark in commerce, or on a foreign registration, and no party files an opposition or request to extend the time to oppose, the USPTO will normally register the mark and issue a registration certificate about twelve (12) weeks after the date the mark was published.

If the mark is published based upon the applicant's bona fide intention to use the mark in commerce, the USPTO will issue a NOTICE OF ALLOWANCE about twelve (12) weeks after the date the mark was published, if no party files either an opposition or request to extend the time to oppose. The applicant then has six (6) months from the date of the NOTICE OF ALLOWANCE to either:

* use the mark in commerce and submit a STATEMENT OF USE; or
* request a six-month EXTENSION OF TIME TO FILE A STATEMENT OF USE.

____ That means that within 6 months we should hear about the next elder scrolls game. 6 months, is considered SOON for video games as they often work within a period of 32 months and longer.

you got my hopes up... but thats the filing they made for the clothing line... meanwhile, the mark they filed for the software is still owned by that ISP called Skyrim. we arent really any closer to a confirmation with this :( tho it is nice to know i could one day soon be sporting a stylish Skyrim hoodie ;)

Actually, the service trade mark is as such
"1. Service Marks:
Service marks are marks used in service business where actual goods under the mark are not traded. It is a mechanism available to protect marks used in the service industry. Thus businesses providing services like computer hardware and software assembly and maintenance, restaurant and hotel services, courier and transport, beauty and health care, advertising, publishing, educational and the like are now in a position to protect their names and marks. As service marks are a particular type of trademark, the substantive and procedural rules governing both types of marks are fundamentally the same."

We can also conclude that it looks like the reason why they abandoned the trade marks in 06 was they went to work on fall out 3, and now are picking them up again for publication, it is also odd that the opposition that that zenimax filed is the day after, so it means they could still be in legal limbo and the trade mark is holding them up which is why they don't want to announce it.

Thanks for clearing that up EvilDude. US Trademark law isnt my forte. I was under the impression that for Zenimax to go ahead & use the Skyrim mark, it would have to be shown that it was sufficiently different to the existing holder. I suppose providing wireless internet & providing open-ended RPGs are different enough, but if the ISP wanted to make things difficult, id imagine they could try.

Has anyone raised the idea that Zeimax could start their own trade show? I'm not talking QuakeCon, because id Has only just been a recent acquisition, but a fully-fledged Zenimax Convention?

Blizzard have BlizCon, & they only have 3 IPs worth mentioning (no offence to WoW, StarCraft or Diablo intended)

Zenimax have an awesome lineup of established IPs :

  • Elder Scrolls
  • Fallout
  • Doom
  • Quake

As well as a pretty good set of new IPs :

  • Brink
  • Rage
  • Haunted
  • Whatever Arkane are working on
  • Shinji Mikami's new studio & whatever they are working on

Anyone else feel that Zenimax could, nay, should try making their own convention show? even if its a bi-annual one? I think Zenimax have enough to easily fill three days of gaming-goodness.

& The Crowning Moment Of Awesome for the climix of their first hypothetical convetion? An announcement of Elder Scrolls V...

well... I can dream.

No it doesn't. They can file up to 5 extensions (for a total of 36 months). This is the reason they let the other trademark application die: they ran out of extensions.

Try not to repeat my mistakes by reading too much into the trademarks. With these we can derive a great deal about what, but nailing a precise when is a precariously elusive venture.

you have lifted me out of the darkness!!!!!!!!!!!!!!!!!!!!!!! WOHOOOOOOOOOOOO YAAAAAAAAAAAAYYYYYYYYYY IM BACK!!!!!!!!! ESV WILL BE

i can already see it, running through tamriel firing off random fireballs and watching them as they sail through the blue sky. Camping out at night and looking at the different planets. getting the map out and picking a random direction to head in! Finding new beasts to slay, raiding forts and selling the loot. exiting the prison to be welcomed by beauty! summoning beasts and watching them chase the deer down for me. All the while listening to a relaxing soundtrack which sweeps me off my feet. I can see the excitement of seeing the game in the stores and walking out with ESV in my hands. First starting it up on my 360, while thinking to myself, "i still remember when i was on the forums and the speculation thread people told me how close it was"

yes, i look forward to the days when all those things happen, i look forward to hearing "ITS BEEN ANNOUNCED!!!!!". That will be a day to remember.

I thought it was made clear that nothing concrete ever comes out of a trademark. Bethesda is not really bound by trademark deadlines. This has happened so many times this year alone where we assumed TES:V had to be announced at a particular date because that's when a trademark expires. That's not the case, however.

The truth is that we will not be able to know when the announcement will happen unless Bethesda tells us. It's like the apocolypse. And I'm beginning to think both will happen on the same day.

Anyone else feel that Zenimax could, nay, should try making their own convention show? even if its a bi-annual one? I think Zenimax have enough to easily fill three days of gaming-goodness.

No, because it would be a gigantic waste of money that they could use for much better things...like TES. I think they're quite content with QuakeCon.

In the last month or so, a lot of people in forums I visit and on podcasts I listen to are buzzing about a new Elder Scrolls game.

I'm pretty sure they plan on converting Quakecon into something like that.

I think the release of New Vegas has brought Bethesda back into the spotlight and has reminded people about their other huge series, The Elder Scrolls, and has made people start to think "Oh yeah, it's been 4 1/2 years since Oblivion... where's TES V?"

Whenever the December GI cover is shown, in my case. Or a little before, if they have a quick thing on the site.
