1. Trademark. By my estimation after reading through the trademark law, and as others have researched and interpreted, Zenimax will need to renew their trademark application for 'Skyrim' by July 19th 2010 (my calculation). If our estimations and legal interpretations are correct, they've already renewed their trademark application the maximum number of times and cannot renew again without verifying its use in commerce. I give this the most reliability because it is a legal issue that falls outside the control of Zenimax/Bethesda. They HAVE to do use the name 'Skyrim' by July 19th or else risk losing their trademark of the name altogether. Sections 2.88 and 2.89 in the trademark law govern this. My theory is that they'll verify Skyrim's use in commerce by accompanying their announcement with purchasable apparel with the Skyrim logo on it (hats, t-shirts, etc.).
I've been researching the trademark as well and your date of July 19 may be correct, but that isn't taking into account the Notice Of Allowance. They can only file for an Extension of Time to File a Statement of Use for 3 years, it's true. But that 3 years starts when they are issued their Notice of Allowance. July 19 is 30 days after the Publication of Opposition, http://www.uspto.gov/trademarks/process/status/next.jsp Assuming it took 12 weeks for Bethesda to get the NOA, that means the absolute final date that they can announce it is October 13, 2010, though it would have to be a bit earlier because they have to file a Statement of Use. They also have the other two trademarks to consider, and those dates are earlier, September 2 and September 16 2010 respectively.
So, assuming that it did indeed take 12 weeks for the Notice of Allowance, Bethesda has until October 13 2010 to announce it. But because we aren't sure just how long it took, it's safe to say that they may need to announce it anywhere between June 2010, when their first two trademarks may possibly expire, until October 2010, when they all will definitely expire.
So we should keep on the lookout from May 2010-October 2010.
Also, I've been looking up how long it takes to file a trademark, and apparently it takes several months. http://money.cnn.com/2007/05/07/magazines/fsb/AskFSB_trademerk.fsb/index.htm, for example, says it takes 15 months to get it through the trademark office, and I've seen other sites say it takes at least a year. That means that if Bethesda allows the trademark to expire, they will have to wait at least a year to announce it, which I simply can't see them doing. So I'm pretty sure they wont allow it to expire.
All of this means that Bethesda HAS to announce TESV before October or November 2010, or else they wont be able to announce it for at least another year.And, if anybody was wondering, the fact that the trademark is still live, and the fact that they haven't registered for any other trademarks related to the Elder Scrolls yet, means that they definitely will be using the Skyrim trademark.
