1.9 Patch and scaling

Followers started leveling with you around patch 1.2 but were limited by a cap. Is this still the case? Also, do enemies scale and what about loot?

I'm sure leveled items are still the same. Some you meet 38+.

I believe followers are still limited by a cap.

No matter. Most of my characters who will be using Legendary skills don't bother with followers anyway.
