So What Now?

So a while ago I got the missing ED-E glitch that everyone else here seems to be getting. After some Google searching I figured I would wait for a patch and that would probably fix it. Well, I was wrong. I finally got around to playing the game again. As soon as it loaded up it told me there was a patch and I happily applied it figuring that since this problem seems to be so widespread that it would obviously have to be addressed in the patch. Start up the game, nope, not there. Look at the map so I can fast travel back to the Lucky 38 and I see him. Right in the north east part of the map. Awesome. I'll just go poke the little turd with a stick and get him moving. One quick fast travel later and I still can find him. He still shows on the map but he isn't there. I go an poke around the only building in the area (Nellis Array) and he isn't there either. Wonderful. I attempt the elevator trick like I did pre-patch. No dice. Wait around a while? Nope.

So I tried the unthinkable. I emailed tech support. What a help they were. They told me to do all the things I already tried. When I told them that that didn't work they told me to either start a new game or return it to the retailer. Well, I would return it but the retailer doesn't accept games that have been opened. How would I have known that the game was broken if I hadn't opened it? The tech support rep also informed me that they couldn't accept returns either. Oh good. I am now stuck with it I guess.

So my question is, what do I do now? Am I really stuck with this buggy pile of garbage or do I have any actual recourse? If I lived in the U.K. I could point to the Sale of Goods Act 1979 and attempt to get a refund that way but I am in the U.S.

And as an added bonus the tech support moron just got back to me and told me that I must have a defective disc. They want to charge me $20 for a replacement that obviously won't fix the problem. Who the hell do they think they are trying to scam me?

I guess that is what you get when you use outsourced tech support that works from scripts instead of having any actual troubleshooting skills.

I know. I can't believe that they would try to scam me into buying another disc. The problem is obviously with the code and not the physical media.
