I dunno, in my experience the guards were rather pitiful at actually arresting you. Killing you they could do, if there were enough of them and you weren't running away.
Here is how my experience whent.
A warm sunny day on the third of first seed, a khajiit walks into a barn, the barn being owned by an orc would not naturally sell stead. Though you wouldn't know by the fact that they all have saddles. He kindly asks if any of the steeds are for sale, a young man replies that they are not. The khajiit, intent on getting a horse to rack up his bounty so he may attract the attention of the thieves guild jumps upon the nearest horse. The stable boy screams at him and pulls out a rusty iron mace yelling, "You won't get away with this!"
To which the smiling khajiit replies "I can if I throw the horse off a cliff... Which I will!" Moments latter the the distant whinny of the horse is heard from the bottom of the cliff. The khajiit picked himself up and dusted himself off. Only to hear the shouting voices of the iron clad city watch bounding to his position upon similar steeds. While they dismounted the khajiit ran full steam to their horses without even a word from the guards the khajiit took to the steed and raced the mighty horse up to the stable, again taking flight and horrendously crashing it into the ground. More guards flocked to the khajiit like a scurrying sword bearing ant parade. Benny hill played, and many more horses flew. At the end of the day five horses lay in a steaming heap at the base of the cliff, and the khajiit was never heard from again.
