A) no they couldn't patch the frame rate, it's intrinsic part of the engine and it's coding and would take Months of work and furthermore they couldn't put it into
A patch, you would have to buy game again.
B) they can't turn off vsynch as it uses a triple buffered system and vsynch on ps3, and seems to work better than double buffering and a soft vsynch as used on 360 version for the ps3. If they did you would get some major ass screen tearing. This system has been employed for other multi platform games in past for this exact reason. U take a bit of a hit on frame rate, but it's better than huge screen tears.
