Bethesda Drops Appeal

Post » Fri Apr 24, 2009 7:18 pm

I just heard the news about the dropped Appeal and wanted to congratulate gamesas on its success in the matter. It is all very unfortunate to have been an issue at all.

Best of luck moving forward untethered with the development of the Fallout Massively multi-player Online Game.

I read it on GameSpot myself. They might have gotten it wrong, sure, but I doubt it. Anyway...

The only thing dropped is an appeal to stop gamesas from continuing development of the Fallout MMO as well as sell old Fallout titles (Fallout, Fallout 2, Tactics, Brotherhood of Steel).

The lawsuit over the Fallout rights is still going on from what I could gather, an injunction is basically to stop people from doing something. In this case it would have been to stop gamesas from making money off the Fallout name.

Yes but if Bethesda wins I believe the money they made from the games up to a certain point would need to go to Bethesda.

aaw, thats bulls**t. Then I'm waiting to buy the games until I know for certain that they will end up in the right pockets :( Bethesda don't the deserve the money, especially since they weren't even part of making the games!

So I'm saying this right here and now, that if gamesas wins and gets to keep the money from the old games, I'm going to buy all three. And if not... bethesda ain't getting anything from me. Image

I think the point of controversy in regards to the non MMO Fallout stuff was that gamesas released a retail product called "Fallout Trilogy" about a year ago IIRC. It was basically a disc that contained Fallout, Fallout 2, and Fallout Tactics for those who wanted them but didn't get them digitally. According to Bethesda the term "trilogy" implied the three main series releases which included Fallout 3. Bethesda believes gamesas was using the success of Fallout 3 to sell a few more copies of their games, gamesas denies this of course.

That being said, I think Bethesda only wanted money made from the "Trilogy" but I could be wrong. I'll do some more digging and see what comes up.

Edit: Well I was able to find this,

http://www.gamasutra.com/view/news/25226/Bethesda_Sues_gamesas_Over_Use_Of_Fallout_License.php

It turns out even the digital versions of Fallout are impacted by the suit as well. I can't find anything on gamesas having to give Bethesda the money they made from selling the games (maybe it was something I read early on when rumors of a lawsuit were trickling out) but they would have to pay for damages and legal fees which could be another way to say the same thing.

Edit 2: Legal issues could take years to resolve, I would recommend buying the games anyway. gamesas will see the money now, Bethesda might not even see it at all or if they do, who knows how big or little their share will be.

I personally think that Bethesda made a mess of Fallout 3, I hope the guys at gamesas get to keep the rights on all the game. I also hope that the MMO manages to make it onto the shelves. I have been hanging out for this and think Bethesda should just drop the suit.

We would prefer it if users did not negatively discuss other companies or products. These forums are for discussion about gamesas and our games.

Many thanks!

No, Beth deserves it, gamesas doesn't. Beth owns Fallout. Deal with it. "Are you ready to die for your country, you commie son of a b!tch!?"

why not? care to expound upon your feelings? it is a bit strange to be on the boards here posting that the lawsuit is a good thing - it certainly is not good if you are wanting to play this game "What would your good do if evil didn't exist, and what would the earth look like if all the shadows disappeared?"
