Yeah. And I can still make a good back-story regardless of that, doesn't affect me at all.
For example, if I was living in Skyrim in the first place, I could say that I went to see some family in Bruma, and when I came back, the Imperials wrongly accuse me of trespassing, and sentence me to death.

But on topic, You can still easily make a backstory for your character even though it's specified that you were caught coming over the boarder.
My Dark Elf murdered a noble and the authorities doesn't want that to be publicly known so they sentenced him for crossing the border illegally instead.
I Can still use my made up reason, now its actually even better, I mean it wouldn't be good for the guards if the people knew that I tried to help an old man from being hassled and beat up by corrupt guards. :toughninja: So I guess I was just sentenced for crossing the border illegaly.
