My construction set CD broke during a recent move and now I have no way - as far as I can tell - to access the game's .nif files and the like.
Is there a way I could download the construction set, or would I have to order/purchase another CD? Or do not I need the actual CD to access or import .nif files into blender? All I seem to be able to import are files from mods, not from the actual game.

You can still use programs like http://planetelderscrolls.gamespy.com/View.php?view=Utilities.Detail&id=32 to unpack game BSA files.
