What gives with the FPS?

Specs"

AMD Phenom II X6 2.80ghz
ATI HD 6850 1gig ddr 5
RAM 8gigs ddr 3
1tb Hard drive


Getting pretty bad frame rates in town and the game as a whole even while using the recommended game settings *high*. I havent tried setting things to medium because I find it stupid how the game says I should play it on high settings but yet I lag while outdoors.
The cursor seems to be tied to the FPS and thankfully I have a razor mouse that I can tweak sensitivity levels in the fly, however even at max sensitivity it's pretty difficult moving the cursor around with the bad frames.

What gives? I have a pretty good rig everything rates at 7+ in windows ratings except for my hard drive *not solid state*.
Is it a hardware issue or is the game bad optimized? Ive been waiting forever for this game :(
