What happens when you disable DX11? POM is not a DX11 feature, allthough it may be connected, but not likley.

Well there are other dx11 features in this so that wouldn't be ideal. Just wondering a way of turning tessellation off without doing it in the ccc.

As the OP said, POM and Tess share the same slot which is Object. You gotta set it to ultra to get them working. Afaik there is no list of Ultra CVars out by now. Maybe you can live with a workaround for the time being. Just turn of tesselation in you gfx card setup tools.

I am wondering why POM and Tess made it to the same slot, as well. Activating POM at the extreem Object level would have been quite ok, tho.

It really would be nice if Crytek would come up with a new CVar Whitelist for patch 1.9.

That turns off water tessellation though I still want that on (as it isn't as badly optimized as object tessellation).
