Fallout Gameplay on Youtube

So I got a new Hauppauge HD PVR for my Xbox 360 and to test it out, I filmed some Fallout 3 gameplay. I was going to send a friend of mine the video because he's never played a Fallout game before. So I went on Facebook and tried to send him the video through a message... doesn't work. Then I figured I'd send it through an email.. file's too big. My last option is Youtube, or at least my last convient one anyways, but I know how stubborn they are with the whole copyright thing. How can I post a private video of my gameplay without them taking down the video? I am aware other people upload coprighted material all of the time; do their videos stay up because they put the disclaimer saying they don't own the content? Should I give Bethesda and ZeniMax credit in the description? How does this whole thing work?

Actually, it depends on what you're using it for.

If you're using Copyrighted material for your personal benefit (i.e. selling it,) it's a no-no. If you're using copyrighted material in a parodic, educational, or slapping something together for the hell of it with no intent on making money off of it, then it's generally fine.

The hardest hit people are the guys who put up whole episodes and/or complete songs. A Lets Play! video is generally fine, as watching someone play a videogame is nothing like actually playing it.

In other words, go ahead. Or you can direct your friend to one of several Fallout 3 lets play that are already on You Tube.

No, I don't want to or plan on making money for the video, it's simply to show my friend a little about the game. Thanks for the help.
