Headless zombies cannot happen whatsoever. Because they're headless their spinal cord has been severed from the neck which means that anything below the neck cannot work which means headless zombies should not even function as zombies. Zombies with heads however can function and zombie heads can infect people even if they have been separated from their bodies.

Bethesda should patch this; anyone agree?

No it would work as long as their spinal cord was intact; which it most likely is. Which is why you can disable a zombie by severing its spinal cord, not just destroying its brian. Of course even after you disable them by severing their spinal cord, everything above the severed spinal cord would function so the zombie could still pose a threat.

There are two basic types of zombies my friend. The first type, which you are doubtlessly thinking of, were popularized by George Romero. They are the "You gotta shoot 'em in the head" type. Making them easy to kill. But they also turn everyone they injure or kill into a zombie as well. So they breed exponentially. The second type is the fantasy novel type. These fellas do not have the achille's heel brain of the Romeroans. They are created by foul sorcery, and typically have be literally taken apart to be stopped. However, because of how they are made (i.e. an evil necromancer does some kind of magic on a corpse), they do not make more zombies just by injuring people. The only way to make more fantasy zombies is for Ned the Necromancer to slave away in his lair all night over a hot corpse.

So fantasy zombie does not need a brain, or head, to do his thing. Only the Romeroan zombie does.

Zombies are undead they don't obey the rules of physics, also I don't think Bethesda's going to be making patches for Oblivion any time soon.
