Realistically lets say they just use Havok Cloth for cape/cloaks and skirts/dresses (they can stick to jiggle bones for hair), the chances of seeing more than, oh, ten of them on screen at a time are pretty slim unless EVERY character has a cloak, and even then, how many people did you see on-screen at once in Oblivion? It doesn't come with a particularly large performance hit either, from what I've read, so I can't really see that aspect being an issue. The real problem would come with teaching modelers how to do it. I'm not sure exactly how Havok Cloth works, but it may be as simple as selecting a mesh and ticking a particular box when it is compiled, so potentially not a problem at all.
