Now that I see what you mean, I don't really think torture needs to be a feature in TES. We already have decapitations and what not.

Having torture in Skyrim would make it harder to sell in some if not many countries due to their restrictions about violence in video games. So I'm thinking we won't see torture in Bethsda games ever.

The brotherhood already fulfilled this role... so just join them. Besides with a mixture of magicks you are able to do this anyhow. stab+calm+heal+fire+calm+heal+frost+calm+axe to the head+calm+heal+wabberjack+calm etc... and other wonderous mechanics in game to exploit and inflict discomfort on various NPCs and creatures.
