I have read from numerous sources that patches only affect a new game. A game under the current set of patches has fixed this since I have played two games and joined the Thieves Guild without any problems from Brynjolf. However, since 1.9 fixes so many other issues you will probably have a more problem free game if you wait for patch 1.9. I may be wrong but I believe the release date is at the end of the month or at least that is when the patch is rumored to be released. Google translation into Italian:

I remember this now. I failed that quest. Had to go to jail. But Brynwolf still let me join the Thieves Guild.
Prayer, manually save often, at least every hour. Keep at least 1 save every day. Then just go back to an older save when you get a glitch. This method has worked for me for 15 months, on the PS3 and Xbox.

EDIT: Sorry fixed. I guess Google defaulted back to Spanish when I thought it was translating to Italian.
