What determines whether or a soul is black or white is down to Arkay's divine protection.
Except that Giants and Falmer are not creatures.

But what makes a person a person? Are the betrayed not people, if so then why? They are as much of a person as the Man or Mer races, the only difference is that they have white souls, are they to be labeled as creatures just because of their souls?
The second part of your post also raises the question, though off-topic, "Is murder only for killing humans (Though technically animals too) only, or when we kill animals would it also count as murder? Why or why not?"
Deny lore? I'm the one presenting lore here. Arkay's divine protection determines the type of soul, not whether it is a person or a creature.
Falmer are not creatures.
Giants are not creatures.
The Daedra are not creatures.
They do not have Arkay's protection, though.
If absolutely nothing changed about the Nords in TES VI, but they were now a white soul would call them creatures?
I was using a hypothetical to build on the other examples of here and now that are considered white souls but are NOT creatures.
You can add the Dwemer to that list as well. The ghosts you encounter in Morrowind were white souls and not black.
