I've searched the forums and I haven't found a fix to this so I'm hoping it's here!

I have the latest update for Skyrim installed and it yet every time I complete the "Dampened Spirits quest I don't get access to Mallus Maccius as a fence. Has anyone found a fix for xbox 360?

Just to be sure, have you returned to Maven yet (after finishing the "job")? Mallus is not available as a fence until after you return to Maven.

Yes I have, and all he says is that he'll be available of I should need a fence but no option to trade

Apparently, there is a rare bug where Mallus (and other fences) sometimes do not give you the option to buy your goods (like you are describing). Although the cause of this bug is unknown, some people have stated that it may be triggered by doing the College of Winterhold quests at the same time as the Theives' Guild quests. If you have a College of Winterhold quest active, you might try advancing further through that questline to see if that helps.

Edit: Also, it sounds like from your original post that you may have already done this, but sometimes reloading a old saved game prior to receiving this quest (from Brynjolf and Maven) may solve the issue.
