If you never go to Solitude (and thus never trigger Roggvir's execution) until the final battle of the Civil War on the Stormcloak side, does Roggvir get to live or is he scripted to die regardless?

Nevermind--the Elder Scrolls wiki says the guards will comment on how they wish they could have gotten there in time to save him if the 'cloaks take the city
well considering most players would have probably gone to Solitude at one point through the game before then, is it really that surprising that nothing was changed? Do you honestly think it is laziness on their part to not have anything different happen on such a small part of the game.
A prison break quest to break him out before he's executed would have been very much appreciated.
