But if the war never happened then that raises some interesting questions, since the Fallout world before the war is marked with extreme instability and open warfare. Is it just that the wars never go nuclear? Or maybe there's some sort of massive disarmament program. Even then, the American citizens pre-war were pretty much got stripped of their rights as the situation got more and more desperate. Even if I was a American, I wouldnt want to live in that world.

No, I wouldn't want to live in the prewar Fallout world. This is a place where companies put deadly radioactive isotopes into toy rockets (to make them glow!) and hand them out to children.
