Are you using other mod? Have you tried some of the suggestions here: http://www.uesp.net/wiki/Skyrim:Blood_on_the_Ice#Bugs

The fourth one down? Did you capture windhelm for imperials?

Ahh, BOTI. The most bug-plagued quest in the entire game. we USKP folks just looooove it, sarcastically speaking.

If you read the uesp (Bugs section) that jasper1979^D suggested, you will find a workaround. !!!

Except you using mods that could hinder the game to proceed normally.
