Using rendition of musics: legal or not?

A while ago, I asked a Nexus moderator (don't remember which, I think it was Buddah) if it was okay to use a rendition of a videogame soundtrack in a mod; by rendition, I mean someone who played the music track by himself on a piano, not using the game's assets but obviously reproducing the music.

The moderator told me it was okay to do so. The reason I'm posting this message, is that I want to make sure this is still okay before I upload my new mod; I got the authorization from the Youtuber to use his work so this side is clear. So my question is: is it okay to use a music played by someone, and that is inspired by a videogame/movie soundtrack?

No money involved, so how should it be illegal? You asked the original creator, he's ok with it. I think he's supposed to be more concerned about copyright issues then you.
