So I've been playing Skyrim for a few years now, and I've never been able to do the Dark Brotherhood quest line. I've bought a whole new game thinking maybe it was the disk but it whenever I go to "Rest" even just for one hour, to start the Dark Brotherhood, the loading screen shows up and it stays on my screen for as long as I decide until I quit the game. It's not frozen because the smoke is moving and I can go into the XMB menu. Ive turned off auto saves and it still does it. Can someone please tell me what I need to do to finally play this questline?

Are you sleeping in a bed? I think just waiting doesn't work. If you've done the pre-stuff, and you sleep in a bed, it should work fine. Can you sleep in a bed before doing the setup for the DB questline?

Yes, I can sleep fine before hand, I can also wait with no problem. As soon as I get that dang note everytime I go to "rest" it's just an infinite loading screen with moving smoke.

This might be a problem with a mod, if you're using any?

Nope no mods, just plain ole' legendary edition that I just got today. could it be my ps3?

Is there a certain level you have to be to even start DB? I Made a new save file so I'm only level 7.

There's no level requirement; as soon as you get the letter the quest should start. I checked the http://www.uesp.net/wiki/Skyrim:With_Friends_Like_These...and http://elderscrolls.wikia.com/wiki/With_Friends_Like_These...#Bugspages for the quest and they both mention the game freezing after you get the note but neither suggest any fixes. It's for a different bug (no letter from the courier) but UESP says that sleeping immediately after telling Aventus that Grelod is dead might cause the quest to start right away without needing the note. I don't know if it'll work but it's worth a shot if you have an older save.

If that doesn't work, the only thing I can think of is uninstall all of your Skyrim stuff and start over from scratch. I'm on PS3 with the legendary edition as well and I've never run into this problem.

I just did a quick format on my system, the game was still freezing on my brother profile on a completely different part of the game.. It's been freezing on that part since we've started playing but only on his data. So I'm betting on corrupted data. I'll definitely give your advice a go though!
