Copyright Infringement

I beleive it is only copyright infringement if they just copied and pasted the vault boy. However if they just replicated it, I beleive it is ok.

Not sure if it has to be making money or not it's hard to say really. However I know that if someone takes another company's item them slaps it in their stuff and makes money off it that's the best sure fire way to get a C&D letter along with being sued. When you start deviating from things and changing things then it becomes a grey area unless it's a special case. I remember a news article a while back where the people that own iHOP and that logo are suing a church because they copied the ihop logo. The church called itself the International House Of Prayer which was kind of stupid imho cause they probably new full well it would be shortened to ihop and thus garner the eye of the International House Of Pancakes.

Considering its the FREE information society, I'm pretty darn sure they aren't making ANY money off of ANYTHING.

While profiting is necessary for some licenses (like certain creative commons), it is not required by a good many, especially commercial licenses

Of course, it is entirely possible that they were given the green light to use it, and/or that gamesas doesn't own the copyright to it (only a copyright owner or someone who represents the owner can charge someone with copyright infringement)

Moddding consoles and making backup game DVD's may be okay?, I think. I saw it being advertised on IGN a bunch of times. You know "MOD YOU XBOX NOW" And "LEARN TO MAKE BACKUP DVD's". Those advertisemants. I mean.. if a video game site like IGN has those kind of advertisemants...?

It's not legal, and those ads were in all likelyhood generated through Google Ads. Even Blizzard has had the mishap of getting goldselling/powerleverling ads on their official websites.

Doesnt make sense why they would allow it to be advertised on there. Did Blizzard fix that problem?

But the ads which appear are not really defined by them, obviously they can choose to only advertise under eighteen stuff. Besides, the ads that come up through google/adsense tend to be engineered to whatever the IP was viewing earlier, I'm consistently getting adverts for Vista office cards just cos I had a browse of the site a few days ago.
And I doubt the site which is being paid host the Advert frame, which all the ads are displayed, would be party to prosecution, or responsible, but rather who ever the advert directs the user to.
