Bethesda sues Interplay over Fallout Online and original Fal

Ah apparently that's the UK version as well.

I can find no evidence of anything using the 'Trilogy' term prior to the one that seems to be in question, which was released well after Fallout 3.

I've bought the "Fallout Collection" recently. I can't find the term "Trilogy" anywhere on the box. However, one thing is odd... The store that printed the prize and bar code label identifies it as "Fallout Trilogy". Still, like I said, Interplay's box didn't mention the word "Trilogy". This version is distributed by "Virgin Interactive Entertainment (Europe) Ltd." and is owned by "Virgin Enterprises Ltd.".

According to http://www.virgin.com/company both these companies do not exists anymore. So, I must have bought the 2004 version.

Edit: ... For 5 euros. ;)

I'm doubting the words of Frymuchan, simply because he is a shareholder, and that Interplay has not given an official word on it, as far as what has trickled down the graqevine.

Now, if Interplay released some press releases regarding this issue...

Hmmmmm....thinking something here.

If -as Interplay claims- Bethesda's alleged actions renders the licence sale null and void, does that not also mean that Interplay has to repay the money Bethesda paid them for the licence?

In the unlikely event they can somehow acheive the miracle of getting the sale revoked, won't Interplay simply be destroying itself out of spite?

(This is of course, based on my flimsy knowledge of contract and licensing law :) )


Fact is though, this whole countersuit is a delaying tactic to hold off Bethesda's case against Interplay. Interplay failed to meet their contractual requirements in regard to the MMO and if they failed to also meet the requirements regarding packaging and distribution, then they haven't a leg to stand on.



Finally, has there been any additional evidence other than that one forum post that Interplay has even launched a countersuit?

Exactly my point; take what you find on the internet with a grain of salt unless proof can be found in a reputible source. In this case, since Interplay hasn't released an official press release (that we know of,) or court documents released to the public, we can't take Frymuchan's words for the absolute truith in this case.

You should probably doubt his words because he is obviously wrong on a number of points. And nothing that he describes in his rant actually addresses the key points of Bethesda's suits, namely that IP didn't raise the cash for FOOL and IP didn't check the packaging for the Fallout Trilogy with Bethesda before selling it.

Regardless, this will likely be settled out of court with Beth getting back the rights to FOOL, and IP getting enough cash to stay afloat for a while longer.

That's my best guess. They'll settle. Interplay will get to keep the right to sell the old games (in a new box not called 'Trilogy') while the online rights are taken away from Interplay.

Huh, so the guy on Joystiq also is making a news article of a stock site forum post. Geesh. I mean, I can see why the wiki did that - it's a wiki, they can technically put up anything. But you'd kind of hope a site wanting to be taken seriously would want a little more to go on than "uhm, yeah, this dude? On this stock site? He says he saw legal stuff, right? So I will print what he's saying."

In the wierd and extremely unlikely event INterplay somehow wins back the rights for Fallout, they'll want to milk the series as much as possible while it's on a high.

You know what that means?

Brotherhood of Steel 2! :facepalm:

Apart from maybe one or two of the original devs, Interplay has no one from the original development teams with them (They're all at Obsidian), so anything they do produce will still be nothing like the originals.

So? They wouldn't do it themselves, they'd hire Obsidian to do it for them and they'd just publish it.

It's surprising how much things change in just a few short years in that kind of business.
Just imagine it... the year is 2029, the big news in the gaming industry: Interplay buys the rights to the Elder Scrolls 9, 10 & 11 and sues Bethesda for selling TES IV: Oblivion, TES V: Skyrim & the highly controversial TES: The Dark Brotherhood of Steel: A Post Apocalyptic Role-Playing Shooter in Tamriel.

Yeah, but it doesn't just happen overnight. It takes years of mismanagement. Right now, Zenimax is doing a pretty well.

The sad part is that things like this distract both companies, and we the player are the ultimate losers in such duels (most of the time). Who knows when or even If we will see a Fallout MMO now, and this will cost them both alot of money. I like the bald men fighting over a comb anology - as in the grand scheme of things, it seems so much like "Much Ado About Nothing".

I don't imagine it's much of a distraction for Bethesda's developement team, none of their projects are likely to be affected. However I don't envy the V13 team at Interplay, the last few months have surely been difficult and I don't Masthead is pleased either (although they at least have their own project they can work on).


I agree that it's unlikely that we'll see V13 see the light of day but to be honest I considered this unlikely from the get go. Let's remember that Interplay first started talking about this project before they even sold the Fallout 3 rights to Bethesda.
