If not sue them looks like same game

There are trees and grass in both games. You're gonna need more evidence than that...

It isn't like they stole Oblivion's code, and just put their name on it, so Bethesda cannot sue them, and even if they could, they wouldn't, because it looks somewhat similar.

Bethesda didn't invent generic western fantasy.
