Liberty Prime pathing

I am having a small problem trying to get a liberty prime to patrol where I'd Like. I have a split level cell where the navmesh is on both the upper and lower levels. Every way-point that is on an upper level has the LP trying to reach it from the lower level. He just runs around in circles and can not reach the patrol marker as it is upstairs. He has no problems navigating the stairs, he just seems to prefer to walk under the way-points instead of on top of them. I tried raising the markers up a bit but that only has the effect of LP not being able to path at all. If there is no navmesh on the floor below the way-point, he will navigate the upper floor way-points. The way-points are XMarkerHeading objects. Any ideas?

Can he make it up the stairs? His bounding box is insanely vast, so it could be the case there's a bottleneck on the navmesh somewhere.
For the RobCo bots I typically knock 1/3 off the bounding box but I'm not sure how well that'd work with Prime.

I figured as much. I have gotten around it by adding more way points at the bottom and top of the stairs and make him go through these first when I want him up or down. All of my other waypoints are setup such that he won't be near the staircase and can't accidently traverse them.
