well, so long as we don't have the 30-minutes long tutorial that we can't skip, I'm happy.
of course, that's unless they make it epic, in which case I'll be happy to play it.

and BTW, we know we're a prisonner. but it's never been mentionned if we're a criminal in jail, or a war prisonner

Well there was some discussion and a few people were saying "Ew no i don't want to be a prisoner, why would I want to be a prisoner?"

Obviously people who have never played TES games before ;)

Or they've played all of the games and realized that this wasn't a "tradition" until Todd Howard randomly declared it to be one while developing Oblivion (despite the fact that you're not a prisoner at all in Daggerfall, that you're a prisoner of a pretty entirely different sort in Arena, and that including the spinoffs and side games leaves several other titles that don't start you in jail).

It's the TES tradition. I think what annoyed most people is having to go through a tutorial every time.

If you can't come up with a reason why the character you are RPing would be in jail, then your backstory needs work.

The tutorial better be "Someone paid your bail, here's a letter from him, get out".
And then you're booted out onto the street with a letter, a gold coin or two, some clothes, and some kind of shanking device.

Not really, It just allows the player to construct their own past. Honestly, I haven't seen many games where you start in prison.
