Subway trademarks the word "Footlong"

Post » Sat May 28, 2011 6:29 am

They will never be able to patent or trademark Footlong. They did not invent the term, they only use it.

The fact that they didn't invent the term doesn't by itself make a difference; borrowed words like "Apple" are sound trademarks just as coined words like "Kodak" are.

What matters is that there's a good argument that "Footlong" is merely descriptive: it describes a quality of their sandwiches that is no different from any other sandwich made from a 12-inch roll. Descriptive terms can't be trademarked unless they've become entrenched or famous, such as "Bank of America".

subway is nasty. they are the mcdonalds of sub places. maybe they should concentrate and making decent subs before they worry about their silly ad campaign. also footlong has been in use forever so its not a word that they invented or came up with. i would love to [censored] slap the person that allowed that stupid trademark.

Subway's trademark on "Footlong" is only applied for; it has not been granted. Unless the PTO is asleep, it will be denied, because it takes only a cursory search to find several thousand non-Subway purveyors of "footlong" sandwiches, most of which have priority over Subway.

Yes, Apple Computers are the same as Apple Records as far as the name goes. Apple could have never TM'd that name alone, only in connection wuth the products it sells. However, people do not use Apple as an Adjective, at least by itself. As a descriptive term, Subway did not invent Foot Long, they just applied it through a Marketing Campaign.

If subway ends up owning 'footlong' will the general public still have 'foot long' and 'foot-long'.

I'm just wondering if Raithen, like most people I know, including myself, likes salt, pepper and vinegar sprinkled on his footlong. *stares at Raithen*

You don't like mayonnaise on your footlongs? I like so much that it drips from the end that I don't bite into.

That must hurt :cold:. And while I might simply be stuck in the past, aren't you a bit young for that sort of thing?
