Yes. I have a good solution that is very lore friendly; if you simply refuse to acknowledge Oblivion as canon, then you don't need to think about these things.

And now you just gave the reason why there is no levitation in Cyrodiil. It violated the divine rule of "Things Fall Down" and therefore had to be removed.

On a different tangent, I've heard the reknowned imperial scholar named Isaacus Newtonus, who studied the laws of the earthbones, exclaim the following sentence while investigating "Things Fall Down":
"The Tarhiel doesn't fall far from his scroll."

The Levitation Act was passed in 3E 421, the events of Morrowind started in 427. So we can assume that it either does not encompass the province of Morrowind or is not enforced.

maybe the same laws that let them keep slaves let them fly as well?
