In an interview Todd mentions that you we're caught coming over the border, and that's why you're in jail. Seems odd, but that's what he said. Maybe it's your character coming from Cyrodill? Morrowind? Maybe you forgot your passport?

Maybe you headed over to Morrowind because the drinking age is lower, or their prescriptions are cheaper, or they have more relaxed drug laws.

Your local mead hall ran out of mead so you took a short trip to Bruma, then when you tried to get back to Skyrim carrying many crates of Mead, guards arrested you for smuggling mead, after which you got angry and killed the guards... Then the second wave of guards captured you.

Oh the irony behind border hopping.
Maybe you heard that dragons were in Skyrim and you wanted to see this for urself but you were caught by the border patrol for growing a beard haha.

I really like this tradition, being a prisoner is a nice start which there can be a multiple of reasons as to why you are there.

However, the fact that we are on our way to our execution, kind of cuts down the number of reasons why you are in jail, given that you'd have to have done or mistaken to have done, something which deserved such a harsh punishment, unless the law in skyrim is extremely harsh.

you could be caught trying to flee the country or just happen to be near the boarder.

there's a civil war going on. you probably got picked up by some random company out in the Frozen Wastes? who figured they'd just kill you. i'm somewhat doubtful you're in a city prison, since they've said the first town you arrive at is Riverwood and that's pretty deep into the mountains away from any major cities.
